Registered Declaring Agents (DAs) and Declarants must comply with the applicable Terms and Conditions, which outline the responsibilities, conduct, and due diligence expected when submitting trade declarations.

For DAs: This document explains the responsibilities of DAs under Part IVA of the Regulation of Imports and Exports Regulations and Part XIVA of the Customs Regulations. Determining ‘Fit and Proper’ Status
When assessing whether a Declaring Entity (DE)E, DA, Declarant, or Key Personnel is fit and proper, Singapore Customs may consider factors such as (but not limited to):
Any offence or breach of Terms and Conditions by the DE, DA, or Declarant
Whether the Key Personnel of the DE or DA has committed, or is suspected of having committed, any offence or breach
A Declarant’s knowledge and practical experience in making trade declarations
Consequences of Non-compliance
Non-compliance is an offence. Singapore Customs may take enforcement action, which may include:
Suspension or revocation of DA or Declarant status
Downgrading of DA banding and related benefits
Composition sums, court fines, and/or imprisonment
Important:
Suspended or revoked DAs and Declarants cannot submit permit applications through TradeNet®.
Examples of Non-compliance
Non-compliance may include:
A DE, DA, Declarant, or Key Personnel committing an offence or breaching the applicable Terms and Conditions.
A DE, DA, Declarant, or Key Personnel no longer being considered fit and proper.
Failure by a DA to renew its DA status within the stipulated renewal window.
Failure by a DA to maintain a valid Inter-Bank GIRO arrangement with Singapore Customs.
Breach of conditions stated in a Customs permit.
